By using our website, requesting a quotation or engaging us to provide services, you agree to these Terms & Conditions together with any specific terms contained in your quotation, proposal, order confirmation or service agreement. If there is any conflict between these general Terms & Conditions and a written quotation or contract agreed with you, the terms of the specific quotation or contract will take priority.

Extractor Experts Ltd provides commercial kitchen extraction and ventilation services throughout the UK.

Our services may include:

You can contact us through our website, by telephone or by email to discuss your requirements. Where appropriate, we may arrange a site survey before preparing a quotation. During a site survey, we may assess matters such as:

A site survey does not create a contract unless otherwise confirmed in writing.

Acceptance of a Quotation

A contract will generally be formed when you accept our quotation or proposal in writing, pay any required deposit or otherwise clearly instruct us to proceed. Once accepted, the quotation, these Terms & Conditions and any agreed project documentation will form part of the contract between you and Extractor Experts.

Prices and VAT

Prices will be set out in the relevant quotation or invoice. Unless otherwise stated, any applicable VAT will be added at the prevailing rate. Additional work that falls outside the agreed scope may result in additional charges. We will normally discuss significant additional work with you before proceeding.

Deposits and Payments

Where a deposit is required, the amount and payment deadline will be shown in your quotation, order confirmation or invoice. Remaining payments must be made according to the agreed payment schedule. Invoices must be paid by the due date shown on the invoice. We may suspend further work where an undisputed payment is overdue, subject to applicable law and the terms of the relevant contract.

Changes to the Scope of Work

If you request changes after accepting a quotation, we may need to revise:

  • The project price

  • Materials or equipment

  • Installation method

  • Project schedule

  • Completion date

Any material variation should be agreed between us before the additional or changed work is carried out. If unexpected site conditions are discovered during installation, we will explain the issue and discuss any necessary additional work wherever reasonably possible.

Customer Responsibilities

To allow us to perform our work safely and efficiently, you are responsible for providing reasonable access to the premises and relevant work areas.

Depending on the project, you may also be responsible for:

  • Providing accurate information about the property and project

  • Ensuring we have suitable access at agreed times

  • Informing us of known hazards or restrictions

  • Obtaining landlord or property owner consent where required

  • Providing access to electricity, water or other facilities where reasonably necessary

  • Ensuring areas surrounding the work location are reasonably clear

  • Providing information about existing services, equipment or structures

You should tell us before work begins about any known asbestos, structural problems, restricted areas, hazardous materials or other safety concerns.

Planning, Building Control and Other Approvals

Certain extraction or ventilation installations may require planning permission, building control approval, landlord approval or other permissions. Unless our quotation specifically states that Extractor Experts is responsible for obtaining a particular approval, the customer remains responsible for obtaining the necessary permissions. We may assist with technical information or documentation where this forms part of the agreed service.

Installation and Project Timescales

Any installation or completion dates we provide are estimates unless expressly agreed otherwise in writing. We will make reasonable efforts to complete work within the expected timeframe. However, delays can sometimes occur due to circumstances outside our reasonable control, including:

  • Material or equipment availability

  • Supplier delays

  • Severe weather

  • Restricted site access

  • Unexpected building conditions

  • Changes requested by the customer

  • Third-party contractors

  • Utility problems

  • Regulatory or approval delays

Where a material delay occurs, we will aim to keep you reasonably informed.

Materials and Equipment

We aim to use equipment and materials appropriate for the agreed installation. Where a specified product becomes unavailable, we may propose a reasonably suitable alternative. We will not make a significant substitution that materially changes the agreed specification without discussing it with you first.

Compliance and Standards

Extractor Experts aims to design and carry out work in accordance with applicable requirements and relevant industry standards relating to the agreed scope of work. The appropriate requirements may depend on the type of premises, equipment, installation and local authority requirements. Where third-party works are required, such as structural, electrical, gas, roofing or specialist building works, these may need to be completed by appropriately qualified contractors.

Repairs and Fault Finding

When providing repair or diagnostic services, we will use reasonable care and skill to identify the cause of the reported problem. Some faults cannot be fully identified until equipment has been inspected, tested or dismantled. Where additional faults or required repairs are discovered, we may provide recommendations or a further quotation. Repairing one identified fault does not guarantee that unrelated components will not subsequently fail.

Maintenance Services

Where we provide planned maintenance, the work included and frequency of visits will be set out in the relevant maintenance agreement or quotation. Regular maintenance can reduce the risk of breakdowns and performance problems, but it cannot guarantee that equipment will never fail. Customers remain responsible for operating systems appropriately and reporting known faults or unusual system behaviour.

Emergency Call-Outs

Emergency or out-of-hours services may be subject to separate call-out charges, labour rates or minimum charges. Where applicable, these charges will be explained before attendance or set out within an existing service agreement. Attendance at an emergency call-out does not necessarily mean that a permanent repair can be completed during the first visit if specialist parts, equipment or further works are required.

Cancellation and Rescheduling

If you need to cancel or reschedule agreed work, please contact us as soon as possible. Cancellation terms may vary depending on the project, materials already ordered, work already completed and any specific conditions included in your quotation.

Where bespoke equipment, fabricated ductwork, custom canopies or other made-to-order materials have already been ordered or manufactured, costs already reasonably incurred may be payable where permitted by law. If you are acting as a consumer rather than for business purposes, nothing in these terms affects any statutory cancellation or other rights that apply to you.

Cancellation by Extractor Experts

We may cancel, postpone or suspend work where reasonably necessary, including where:

  • The working environment is unsafe

  • Access cannot be provided

  • Required information has not been supplied

  • Payments remain overdue

  • Circumstances outside our reasonable control prevent us from carrying out the work

Where reasonably possible, we will explain the situation and attempt to arrange an appropriate solution.

Workmanship and Defects

We aim to provide our services with reasonable care and skill. If you believe there is a problem with our workmanship, please contact us promptly and provide reasonable details of the issue. Where we are responsible for a defect in our work, we will assess the issue and, where appropriate, take reasonable steps to rectify it.

This does not cover problems caused by:

  • Misuse or neglect

  • Unauthorised alterations

  • Work performed by another contractor

  • Failure to maintain equipment

  • Normal wear and tear

  • Existing defects outside our agreed scope

  • Damage caused by third parties

  • Circumstances outside our reasonable control

Manufacturer warranties may apply separately to certain equipment.

Third-Party Products and Warranties

Some equipment installed by us may be manufactured or supplied by third parties. Where applicable, manufacturer warranty conditions may apply. We cannot provide a greater warranty for third-party equipment than the manufacturer makes available unless we specifically agree otherwise in writing.

Limitation of Liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to applicable law, we will not normally be responsible for losses that:

  • Were not reasonably foreseeable

  • Were caused by inaccurate information supplied by the customer

  • Resulted from unauthorised changes to our work

  • Were caused by third-party contractors

  • Resulted from failure to follow maintenance or operating recommendations

For business customers, any additional limitations or liability provisions contained in an agreed commercial contract or quotation will also apply.

Nothing in these terms affects rights that cannot legally be excluded.

Business Interruption

Commercial kitchen extraction equipment can occasionally require maintenance or repair. Customers are responsible for maintaining appropriate business continuity arrangements where equipment failure could affect their operations. We will make reasonable efforts to minimise disruption while carrying out our work but cannot guarantee that every project or repair can be completed without interruption to normal business operations.

Intellectual Property

Unless otherwise stated, the content of the Extractor Experts website, including text, graphics, branding, photographs and design elements, belongs to Extractor Experts or is used with permission. You may view and print website content for personal or internal business reference. You may not reproduce, republish, distribute or commercially exploit substantial parts of our website without prior written permission.

Project Drawings and Designs

Technical drawings, designs, specifications or other documents prepared by us remain subject to applicable intellectual property rights. They must not be reproduced or used for another project without permission unless otherwise agreed in writing. Any licence or ownership arrangement specifically agreed in a project contract will take priority over this general provision.

Severability

If any part of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.

Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our website, services, business practices or legal requirements. The latest version will be published on this page together with the updated revision date. Terms applying to an existing contracted project will normally be those agreed when the contract was entered into unless both parties agree otherwise or the law requires a change.

Governing Law

These Terms & Conditions and any dispute arising from them are governed by the laws of England and Wales, subject to any mandatory rights that apply to consumers. The courts of England and Wales will have jurisdiction, except where applicable law gives a consumer the right to bring proceedings elsewhere within the United Kingdom.
